Akron, Ohio, Sept. 9, 2016 - The City of Akron announced today that on Monday, September 12, 2016 it will resume the use of its traffic cameras in school zones as it has been doing since 2005. The program was temporarily suspended last spring while City officials reviewed new requirements imposed by the Ohio State Legislature.

“Safety is the primary reason our city uses traffic cameras in school zones,” said Mayor Dan Horrigan. “Our true goal in this matter is to provide the children of our community with the safety they deserve as they walk to and from school.”

Although there is pending litigation regarding the constitutionality of SB 342, which places new procedural requirements on municipalities’ use of traffic cameras, the use of traffic cameras is and remains legal. The City of Akron is acting in compliance with SB 342 while the litigation is pending including the presence of a police officer at the location of the traffic camera.

While there has been some miscommunication on social media regarding the use of traffic cameras, the new legislation does not affect the constitutionality of traffic cameras under the Home Rule Amendment to the Ohio Constitution. In, fact, SB 342 recognizes the use of cameras, although it does place new and burdensome restrictions on their use.

In the meantime, the Akron Police Department Traffic Division reports that the use of these cameras in school zones has reduced dangerous speeding in school zones. All those driving in and around schools are urged to obey the 20 mph speed limit during restricted hours, whether or not there are police officers or traffic cameras present.
